These Terms & Conditions (“Agreement”) govern your access to and use of Ecoms Edge services, including website development, hosting, custom projects, and related digital services (collectively, “Services”). By accessing or using our Services, you agree to be bound by this Agreement.
1. Definitions

Start Date: The date your Services begin, as specified in your order.

Setup Fee: One-time fee for Ecoms Edge to build and deliver your website or custom service.

Custom Projects: Services outside standard packages, billed individually.

Refund Period: The 30-day period from the Date of Purchase within which refunds may be requested.

User Content: Any materials, text, images, videos, or other content you provide for your website or Services.
2. Services
2.1 Ecoms Edge will deliver Services as specified in your order. All Services are customized to meet your requirements.
2.2 You agree to provide all necessary information, materials, and access required for us to deliver the Services. Delays in providing this information may delay delivery.
2.3 We reserve the right to modify, update, or improve Services. Material changes will be communicated, and you may cancel within 30 days of notification.
2.4 Services are provided “as is,” and while we aim for high-quality delivery, we cannot guarantee uninterrupted or error-free operation of any platform, integration, or website functionality.
3. Payment
3.1 All payments are due as specified in your order. Fees must be paid via the payment method you provide.
3.2 For custom projects, you authorize Ecoms Edge to charge your saved card on file for the full agreed amount.
3.3 Failure to pay any fees when due may result in suspension or termination of Services until payment is received.
3.4 All prices are exclusive of VAT or other applicable taxes.
4. Refunds
4.1 New customers may request a refund within 30 calendar days of the Date of Purchase.
4.2 To enable delivery, you must complete all questionnaires and provide necessary business information. Refunds may be requested during the Refund Period, regardless of whether you have completed the questionnaire or received your deliverables.
4.3 After the Refund Period, all sales are final.
4.4 If Ecoms Edge does not deliver your Services within 7 days of receiving all required information, the Refund Period will be extended by the number of days delayed.
4.5 Refunds will include the total amount paid minus any third-party costs incurred, such as domain registration or hosting fees.
5. Customer Obligations
5.1 You agree to provide accurate and complete information for all Services.
5.2 You warrant that any User Content:

Does not infringe third-party intellectual property rights

Is legal, accurate, and not misleading

Does not contain harmful code (viruses, malware, etc.)
5.3 You agree not to misuse the Services, interfere with systems, or attempt unauthorized access.
6. Intellectual Property
6.1 You retain ownership of all User Content provided.
6.2 Ecoms Edge retains ownership of any software, templates, tools, or proprietary materials used to deliver Services, unless explicitly transferred.
6.3 By providing content, you grant Ecoms Edge a non-exclusive, worldwide, sublicensable license to use it solely for delivering Services.
7. Warranties & Liability
7.1 Ecoms Edge provides Services “as is” and makes no warranties beyond those expressly stated.
7.2 We are not responsible for losses caused by third-party services, hosting, or integrations.
7.3 Our total liability for any claim related to Services is limited to the total amount you paid for the Services.
7.4 Nothing in this Agreement limits liability for death or personal injury caused by negligence or for fraud.
8. Termination
8.1 Either party may terminate this Agreement with written notice if the other party materially breaches its obligations.
8.2 Upon termination, your access to Services will end, and any licenses granted by Ecoms Edge will be revoked.
8.3 You may request to transfer ownership of domains or content before termination, subject to any applicable fees.
9. Data Protection
9.1 Personal information is collected and processed in accordance with our Privacy Policy.
9.2 By using our Services, you consent to Ecoms Edge processing your data to deliver Services, manage payments, and comply with legal obligations.
10. Miscellaneous
10.1 These Terms are governed by English law and subject to the exclusive jurisdiction of the courts of England and Wales.
10.2 If any provision is unenforceable, the remaining provisions remain in full effect.
